Neither ESMA nor Sweden's Finansinspektionen will say whether selling crypto services under your own brand, while a licensed firm does the regulated work, needs its own MiCA licence. Both told the news site Kaupr that it depends on how the service works. ESMA said outsourcing under article 73 cannot be used to hand away the licensed firm's responsibility, and that the authorised provider must stay the customer's contractual counterparty.
